Section 504 of the Rehabilitation Act of 1973

Overview

Section 504 of the Rehabilitation Act of 1973 is a federal civil rights law that prohibits discrimination on the basis of disability in programs and activities that receive federal financial assistance. Parlier Unified School District (PUSD) is committed to ensuring that all students with disabilities have equal access to educational programs, services, and activities.

Student & Parent Rights Under Section 504

Students with disabilities have the right to:

  • Participate in and benefit from all educational programs and activities
  • Receive a free appropriate public education (FAPE)
  • Be evaluated prior to receiving Section 504 accommodations
  • Receive accommodations, services, and supports as determined by a Section 504 team
  • Be educated in the least restrictive environment
  • Receive procedural safeguards, including notice and the right to file complaints

Identification, Evaluation, and Accommodations

Students who may have a physical or mental impairment that substantially limits one or more major life activities may be eligible for protections under Section 504. Referrals may be initiated by parents/guardians, teachers, administrators, or other school staff.

The Section 504 team reviews relevant information, including academic performance, medical documentation (if applicable), and teacher input, to determine eligibility and appropriate accommodations.

Parlier Unified School District is committed to ensuring that no student, employee, or applicant for employment is excluded from participation in, denied the benefits of, or otherwise subjected to discrimination under any District program or activity on the basis of disability.

In accordance with Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA), the District prohibits discrimination, intimidation, harassment, or retaliation against individuals with physical or mental disabilities and ensures equal access to educational programs, services, and activities.

Complaint Procedures (UCP & Section 504)

Complaints alleging disability-based discrimination, failure to provide appropriate accommodations, or denial of access may be filed in accordance with the District’s Uniform Complaint Procedures (UCP) or applicable Section 504 grievance procedures.
